2. Eligibility

• You must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher.
• You must have full legal capacity to enter into a binding contract.
• If you use the Services on behalf of a business, you confirm that you are authorized to bind that business.
• You may not use the Services if you are barred from doing so under applicable law, including U.S. export controls and OFAC sanctions programs.

3. Accounts and Security

• Provide accurate, complete and current information when creating an account.
• Keep your credentials confidential; you are responsible for all activity under your account.
• Notify us immediately at hello@forgelogo.co of any suspected unauthorized use or security incident.
• We may suspend or terminate accounts involved in fraud, abuse, chargebacks, or violations of these Terms.

4. Service Description

ForgeLogo provides an AI-assisted logo generation platform. Users can submit brand information (such as company name, slogan, style, colors), generate logo concepts, preview them, optionally purchase credits and download digital logo files. Generation results may vary; AI outputs are inherently probabilistic and may include unexpected variations.

5. Credits, Pricing and Purchases

• Logo generation and downloads may require credits. Pricing, credit packages, currency, taxes (if any) and payment methods are displayed at checkout before payment is captured.
• Credits are a digital service unit, are non-transferable, and have no cash value.
• Unless otherwise stated, credits do not expire while the account remains active and in good standing.
• All purchases are final, except as expressly provided in the Refund & Cancellation Policy or as required by mandatory consumer law.

6. Payment Processing

Payments are processed by third-party payment service providers, including Stripe, Inc. (PCI DSS Level 1 certified) and any additional processors enabled at checkout. ForgeLogo does not receive or store full card numbers, CVC codes or sensitive authentication data. By making a purchase, you also agree to the applicable payment provider's terms and privacy notice.

7. Taxes

Prices are shown in the currency displayed at checkout and may exclude or include applicable taxes depending on your location. You are responsible for any taxes, duties or charges imposed by your local authorities, except for taxes legally required to be collected by ForgeLogo.

8. Acceptable Use Policy

• Do not use the Services to create content that is unlawful, defamatory, hateful, harassing, threatening, sexually explicit involving minors, or that promotes violence or discrimination.
• Do not impersonate any person, brand, business or government entity.
• Do not attempt to copy, replicate or pass off existing third-party trademarks, copyrighted logos or other protected branding.
• Do not use the Services for fraud, money laundering, sanctions evasion, or any business prohibited by our payment partners (e.g., Stripe Restricted Businesses).
• Do not reverse engineer, scrape, overload, probe or interfere with the Services, security or rate limits.
• Do not resell, sublicense or distribute the Services or AI outputs in ways that violate these Terms or applicable law.

9. AI Outputs and User Responsibility

• AI-generated logos are produced by automated models and may resemble or be similar to other works in unforeseeable ways.
• You are solely responsible for reviewing outputs before commercial use, including trademark, copyright and similarity checks.
• We do not guarantee that any output is unique, registrable, non-infringing, fit for a particular purpose or compliant with the laws of your jurisdiction.
• You agree not to rely on AI outputs as legal, financial or branding advice.

10. Intellectual Property and License

Subject to your payment in full, your ongoing compliance with these Terms and applicable third-party rights, ForgeLogo grants you a worldwide, non-exclusive, perpetual license to use the downloaded logo outputs for your business, marketing, branding and merchandising purposes, including commercial use. ForgeLogo retains all rights in the platform, software, models, templates, interface, brand assets and underlying technology. Rights in raw AI outputs may vary by jurisdiction; we make no representation that any output is independently copyrightable.

11. DMCA / Copyright Complaints

If you believe content available on forgelogo.co infringes your copyright, send a written notice that complies with 17 U.S.C. § 512(c) to hello@forgelogo.co (subject: "DMCA Notice"). Include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) URL or description of the allegedly infringing material; (d) your contact information; (e) a statement of good-faith belief; and (f) a statement under penalty of perjury that the information is accurate and that you are authorized to act. Counter-notices may be submitted under 17 U.S.C. § 512(g). Repeat infringers will have their accounts terminated.

12. Indemnification

You agree to defend, indemnify and hold harmless ForgeLogo LLC, its affiliates, officers, employees, contractors and partners from any claim, demand, loss or expense (including reasonable attorneys' fees) arising out of or related to your use of the Services, your AI outputs, your violation of these Terms, or your violation of any third-party right, including any intellectual property right.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORGELOGO LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) USD 100 OR (B) THE AMOUNTS YOU PAID TO FORGELOGO IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow such limitations; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

15. Termination

You may stop using the Services at any time. We may suspend or terminate your access for violations of these Terms, suspected fraud, abuse, chargebacks, or as required by law. Upon termination, your right to use the Services ends, but Sections that by their nature should survive will continue to apply.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. Subject to mandatory consumer law in your country of residence, the state and federal courts located in Wyoming, USA shall have exclusive jurisdiction over any dispute. The parties expressly waive any right to a jury trial. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

17. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through the Services or via email where appropriate. Your continued use after changes take effect constitutes acceptance of the updated Terms.
